1. The Service

NeverMissCall provides an AI-powered SMS response and lead capture system designed to automatically respond to missed calls via SMS for service professionals.

AI Accuracy: Users acknowledge the Service uses Artificial Intelligence to generate responses. While accuracy is prioritized, “NeverMissCall is not responsible for errors, omissions, or misinterpreted communications generated by the AI.”

A2P 10DLC Compliance: Users must comply with mobile carrier regulations and represent they obtained necessary consent from leads to contact them via SMS. Prohibited content includes spam and high-risk financial marketing.

2. Subscriptions and Billing

  • Monthly billing for all subscription tiers (Solo, Growing, Team)
  • Automatic renewal at each monthly cycle unless canceled via account dashboard
  • Payments processed securely through WooPayments/Stripe
  • Valid payment method required on file

3. 14-Day Free Trial & California Notices

  • New users receive a one-time 14-day free trial
  • Upon the expiration of the 14-day trial, your payment method will be automatically charged for the full monthly price
  • California compliance (SB-313): Notification sent 3–7 days before trial expires with cancellation instructions

4. SMS Messaging & Consent

  • Users agree to receive automated SMS regarding account and service
  • Users are responsible for ensuring leads opted-in to receive SMS
  • Opt-out: Text “STOP” to receive unsubscribe confirmation
  • Help available via “HELP” keyword or admin@nevermisscall.com
  • Standard message and data rates from your mobile carrier may apply

5. Plan Changes

  • Upgrades: Effective immediately with prorated charges for the remainder of the cycle
  • Downgrades: Effective at next billing cycle; features retained through current paid month; no partial refunds

6. Cancellation and Refunds

  • Cancel anytime via the “My Account” page
  • Access continues through the current billing period
  • We do not offer refunds or credits for partially used billing periods or unused SMS/call credits

7. AI Training and Data Usage

Users agree NeverMissCall may use conversation data to train AI models. Data will be obfuscated (removing addresses, dates, and times) and anonymized per our Privacy Policy.

8. Limitation of Liability

Under California law, liability excludes indirect and consequential damages. Total liability is capped at amounts paid in the preceding 12 months.

9. Governing Law

These Terms are governed by the laws of the State of California. Legal actions shall be brought in the courts of California.
