This page explains how and when customers consent to receive text messages from businesses that use NeverMissCall, and how those customers can stop or get help with those messages.

1. Who This Applies To

NeverMissCall is an automated text-messaging platform used by local service businesses — such as plumbers, electricians, and HVAC companies — to respond to customers who call them. When you receive a text under this policy, the message comes from the specific business you contacted. NeverMissCall operates the texting service on that business's behalf; it is not a separate sender you are agreeing to hear from.

2. How Consent Is Obtained

Consent is established by the customer's own action of calling the business. The flow works like this:

  • You call a business that uses NeverMissCall, using the business's own published phone number.
  • If your call isn't answered, you hear a short recorded greeting that tells you the business's AI can text you back to help with your request, and asks whether you'd like a text.
  • If you say yes (or press 1), an automated text message is sent to the number you called from, solely to help with the service inquiry you started.

This is express consent: you voluntarily reached out to the business for service, were told upfront that you would receive a text, and affirmatively agreed to receive it. No texts are sent unless you place the call and agree on the recorded greeting.

3. The Recorded Greeting (Verbatim)

When a call isn't answered, callers hear:

“Hi, you've reached [Business Name]. Our AI can text you right back to give you a quote, answer your questions, and set up an appointment. We're with our customers right now, so if you'd like a text, just say yes or press 1. Message and data rates may apply. You can reply STOP to any text to opt out.”

4. What Messages Customers Receive

Messages are strictly for customer care — responding to your inquiry, gathering details about the job, and scheduling or confirming your appointment. No marketing or promotional messages are sent under this policy.

5. Message Frequency & Rates

Message frequency varies by conversation, depending on what's needed to help with your request and book your appointment. Message and data rates may apply.

6. Sample First Message (Verbatim)

The first text you receive reads:

“Hi! This is [Business Name]'s AI assistant — I can text you a quote, answer questions, and book your appointment. Sorry we missed your call! How can I help? Msg & data rates may apply. Reply STOP to opt out, HELP for help.”

7. Opt-Out & Help

You are always in control of these messages:

  • Reply STOP to any message at any time to stop all further texts. Opt-outs are honored immediately.
  • Reply HELP for assistance, or contact us using the details below.

8. How Consent Is Recorded

For each conversation, the business and platform log the inbound call (the caller's phone number and the time of the call) along with the text messages exchanged, and retain these records as proof of consent.
