Welcome to NeverMissCall. These Terms and Conditions (“Terms”) govern your access to and use of the NeverMissCall website located at nevermisscall.com and the services provided therein (the “Service”). By creating an account, starting a trial, or using the Service, you agree to be bound by these Terms.
1. THE SERVICE
NeverMissCall provides an AI-powered SMS response and lead capture system. The Service is designed to automatically respond to missed calls via SMS to assist service professionals in capturing leads.
AI Accuracy: You acknowledge that the Service uses Artificial Intelligence to generate responses. While we strive for high accuracy, NeverMissCall is not responsible for errors, omissions, or misinterpreted communications generated by the AI.
A2P 10DLC Compliance: You agree to use the Service in compliance with all mobile carrier regulations. You represent that you have obtained the necessary consent from your leads to contact them via SMS. You may not use the Service for prohibited content (spam, high-risk financial marketing, etc.).
2. SUBSCRIPTIONS AND BILLING
Monthly Billing: All subscriptions (Solo, Growing, and Team) are billed on a recurring monthly basis.
Automatic Renewal: Your subscription will automatically renew at the end of each monthly billing cycle unless you cancel through your account dashboard.
Payment: Payments are processed securely via WooPayments/Stripe. You must maintain a valid payment method on file.
3. 14-DAY FREE TRIAL & CALIFORNIA NOTICES
Trial Period: New users are eligible for a one-time 14-day free trial.
Automatic Conversion: Upon the expiration of the 14-day trial, your payment method will be automatically charged for the full monthly price of your selected plan.
Trial Ending Notification (CA SB-313): In compliance with California law, NeverMissCall will send a notification to your registered email address approximately 3 to 7 days before your trial expires. This notice will remind you of the upcoming charge and provide clear instructions on how to cancel before being billed.
4. SMS MESSAGING & CONSENT
User Consent: By providing your phone number, you agree to receive automated SMS from NeverMissCall regarding your account and service. Message frequency varies.
Lead Consent: You are responsible for ensuring your leads have opted-in to receive SMS from your business.
Opt-Out: You can cancel the SMS service at any time. Just text “STOP” to our number. After you send the SMS message “STOP” to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time or text START.

Charges & Liability: Standard message and data rates from your mobile carrier may apply. Carriers are not liable for delayed or undelivered messages.
5. PLAN CHANGES (UPGRADES & DOWNGRADES)
Upgrades: You may upgrade to a higher tier at any time. Upgrades take effect immediately. You will be charged a prorated amount for the difference in plan cost for the remainder of the current billing cycle.
Downgrades: You may downgrade to a lower tier at any time. The downgrade will take effect at the start of your next billing cycle. You will retain access to your current higher-tier features until the end of your current paid month. No partial refunds are provided for downgrades.
6. CANCELLATION AND REFUNDS
Cancel Anytime: You may cancel your subscription at any time via the “My Account” page.
Access After Cancellation: You will continue to have access to the Service through the end of your current paid billing period.
No Refunds: We do not offer refunds or credits for partially used billing periods or unused SMS/call credits.
7. AI TRAINING AND DATA USAGE
By using the Service, you agree that NeverMissCall may use conversation data generated through the platform to train and improve our AI models. As detailed in our Privacy Policy, all such data will be obfuscated (removing addresses, dates, and times) and anonymized to protect the privacy of you and your leads.
8. LIMITATION OF LIABILITY
To the maximum extent permitted by California law, NeverMissCall and its affiliates shall not be liable for any indirect, incidental, or consequential damages (including lost profits or lost leads) arising from your use of the Service. Our total liability shall not exceed the amount paid by you to NeverMissCall in the 12 months preceding the claim.
9. GOVERNING LAW
These Terms are governed by the laws of the State of California, without regard to its conflict of law principles. Any legal action related to these Terms shall be brought exclusively in the courts located in [Insert Your County], California.
